Refinancing in Texas: what’s different

  • Texas has no tax based on the loan amount when you record a mortgage; county clerks charge per-page recording fees. [source]
  • A cash-out refinance of a Texas homestead is a home-equity loan under Section 50(a)(6) of the Texas Constitution. All liens together can’t exceed 80% of the home’s value, the loan can’t close until 12 days after you apply or get the required notice (whichever is later), and only one can close every 12 months. [source]
  • Fees on a Texas home-equity loan are capped at 2% of the principal (not counting interest, discount points, appraisal, survey, the title policy premium and a title exam report), and it must close at the office of a lender, attorney or title company. [source]
  • If you have a Texas home-equity loan, you can refinance it into a regular rate-and-term loan under Section 50(f)(2) only if at least a year has passed, you take no cash out beyond costs and reserves, all liens stay at or under 80% of value, and you get a separate notice at least 12 days before closing. Rules change and every county runs things a little differently, so confirm the details for your loan with your closing agent. This isn’t legal or tax advice.
